There are several ways a person must go about proving that libel has taken place. First, the person must prove that the statement was false. Second, that person must prove that the statement caused harm. And, third, they must prove that the statement was made without adequate research into the truthfulness of the statement. These steps are for an ordinary citizen. In the case of a celebrity or public official trying to prove libel, they must prove the first three steps and they must also in the USA prove that the statement was made with the intent to do harm.[17] In the case of say a newspaper publication, it is extremely hard to prove that it printed its story with reckless or deliberate disregard for the truth since the Sullivan ruling.

The concept of the "public figure" is broader than celebrities and politicians. A person can become an "involuntary public figure" as the result of publicity, even though that person did not want or invite the public attention. For example, people accused of high profile crimes may be unable to pursue actions for defamation even after their innocence is established, on the basis that the notoriety associated with the case and the accusations against them turned them into involuntary public figures.

Why Commencing A Defamation Action Is Not Aways A Good Idea

While people who are targeted by lies may well be angry enough to file a lawsuit, there are some very good reasons why actions for defamation may not be a good idea.

The publicity that results from a defamation lawsuit can create a greater audience for the false statements than they previously enjoyed. For example, if a newspaper or news show picks up the story of the lawsuit, false accusations that were previously known to only a small number of people may suddenly become known to the entire community, nation, or even to the world. As the media is much more apt to cover a lawsuit than to cover its ultimate resolution, the net effect may be that large numbers of people hear the false allegations, but never learn how the litigation was resolved.

Another big issue is that defamation cases tend to be difficult to win, and damage awards tend to be small. As a result, it is unusual for attorneys to be willing to take defamation cases on a contingent fee basis, and the fees expended in litigating even a successful defamation action can exceed the total recovery.

Another significant concern is that, even where the statements made by the ******************* are entirely false, it may not be possible for a plaintiff to prove all of the elements of defamation. Most people will respond to news that a plaintiff lost a defamation lawsuit by concluding that the allegations were true.

In other words, the plaintiff in a defamation action may be required to expend a considerable amount of money to bring the action, may experience significant negative publicity which repeats the false accusations, and if unsuccessful in the litigation may cement into the public consciousness the belief that the defamatory accusations were true. While many plaintiffs will be able to successfully prosecute defamation actions, the possible downside should be considered when deciding whether or not such litigation should be attempted.

Skelton is free to try. His entire life history is open for review. He has claimed numerous times that he is a public figure. Nothing has ever been stated that is not true. If my claims are not true, let the man sue me. I look forward to him trying that. His career will be over in days as information is released to the press, not watch forums.

I've been away for a while and didn't even know that Skelton was fired. Don't watch the shop any more so I wouldn't have found out there. In any event I'm glad to hear it, and I hope he gets everything that is comming to him.

not only do they differ but in the USA you have to prove the person that made a statement, printed, oral or otherwise had the intent to defame someone without sufficient proof of what was being put forward. This is not a hard and fast rule but it is one of the conditions that is weighed. The law is pretty plain. If you state something you know is not true or, should know is not true and it causes harm to another, your are guilty. However, if you state something with reasonable confidence from first hand knowledge or, from sources that any reasonable person would draw the same conclusion, you are safe. With all that mambo-jumbo said, the fact is, we all know the total scam of the brand and certainly Skelton knows and works to support that scam. There have been thousands of posts with reference to these facts and yet not one time has anyone been taken to court. Guess why? They do not have a case and they know it. Besides, if they did make he huge error to take these things to court, when they lost it would further prove the scams they portray. They know that too. So, a lot of lip service but know actions. While "action speaks louder than words", in action speaks just as loudly. For Skelton to ever have any chance at being believed he would have to start by stating, "I am guilty as charged."
